Terms of Service

Cream City Innovations is a software studio based in Milwaukee, Wisconsin. We build custom web applications, portals, and digital tools for local businesses. This website and its subdomains serve as our public presence, and we also build and operate applications on behalf of our partners.

Our sites are provided for informational and functional purposes. You agree to:

• Use the site only for lawful purposes and in a way that does not infringe on or restrict anyone else's use.
• Not attempt to gain unauthorized access to any part of the site, its servers, or any connected systems.
• Not use automated tools (bots, scrapers, crawlers) to extract content from the site without our written permission.

Custom software work for partners and clients is governed by individual statements of work (SOWs) or service agreements signed separately with each client. These Terms do not replace or modify any signed agreement.

If there is a conflict between these Terms and a signed client agreement, the signed agreement takes precedence.

All content on our sites — including text, design, graphics, logos, and code — is the property of Cream City Innovations or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, or create derivative works from this content without our prior written consent. Ownership of work product created under a client engagement is defined in the applicable SOW or service agreement.

If you are an end user of a software application we built and operate on behalf of one of our partners (for example, a loyalty program or member portal), your use of that application may be subject to additional terms set by the partner. We operate those applications as a service provider; the partner is responsible for defining the terms of use for their customers.

Our sites may contain links to external websites (e.g., partner sites, documentation, tools). We provide these links for convenience and do not endorse or assume responsibility for the content, privacy practices, or availability of any third-party site.

Our sites are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that our sites will be uninterrupted, secure, or error-free. Information on our sites may not always be completely up to date.

To the fullest extent permitted by law, Cream City Innovations and its employees and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our sites or services.

Liability for client engagements is governed solely by the applicable signed agreement, not these Terms.

You agree to indemnify and hold harmless Cream City Innovations, its employees, contractors, and affiliates from any claims, damages, or expenses (including reasonable attorney's fees) arising from your violation of these Terms or misuse of the site.

Your use of our sites is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review it alongside these Terms.

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin. Any disputes arising from these Terms or your use of the site shall be resolved in the state or federal courts located in Milwaukee County, Wisconsin.

We may revise these Terms at any time. When we make material changes, we'll update the "Last updated" date at the top of this page. Continued use of the site after changes are posted constitutes your acceptance of the revised Terms.
